What Incoterms® rules do

ICC Incoterms® 2020 rules allocate defined responsibilities, costs and risk between seller and buyer at named points. They do not decide title, payment, product conformity, sanctions or all customs requirements.

Selecting a rule

Select a rule matching the actual mode and handover. State the named place or port precisely and ensure the contract, transport booking, insurance and import plan use the same allocation. Rules for sea transport should not be transplanted mechanically to container or multimodal handovers.

Common mistakes

A term without a named place is incomplete in commercial effect. Do not assume “delivered” means risk remains with seller until destination, or that a seller’s insurance under CIF replaces all buyer cover. Confirm the rule’s version and exact wording.

Practical process

Map loading, carriage, export, insurance, import, unloading and risk points; choose the rule; name the place; reconcile it with the sale contract and documentary credit; then have logistics and legal advisers review exceptions.

Finance context

A documentary credit should describe documents consistent with the selected rule. UCP 600 applies only when incorporated; Incoterms® does not govern bank examination or create a payment undertaking.

Do Incoterms® rules transfer title?

Do they cover every cost?
